Terms of Service

Welcome to Imperia Borealis (the “Game”), an online multiplayer strategy game operated by Visby Wild Crew AB (“we”, “us”, “our”), a Swedish limited company. These Terms of Service (the “Terms”) govern your access to and use of the Game, our websites at apparatengames.com and related subdomains, and any associated services (together, the “Service”).
By creating an account, logging in, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Soft Launch Notice
- Reset, wipe, or reroll game worlds, characters, estates, or progress;
- Add, remove, rebalance, or replace features, content, and game economy;
- Suspend the Service for maintenance, upgrades, or technical reasons;
- End the soft-launch phase and transition to a live release with new terms.
You should not treat your account or in-game progress as permanent during the soft-launch period. We will use commercially reasonable efforts to communicate planned wipes and major changes in advance, but cannot guarantee continuity of progress or content. Silver you have purchased with real money is protected as described in Section 6.
2. Eligibility
- You must be at least 13 years old to register an account.
- If you are under the age of majority in your country (18 in Sweden), you must have permission from a parent or legal guardian, who agrees to be bound by these Terms on your behalf.
- You must have legal capacity to enter into a binding contract under the laws applicable to you.
- You must not be barred from using the Service under the laws of Sweden, the European Union, or your country of residence.
3. Your Account
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- You agree to provide accurate registration information and to keep it up to date.
- You may not share, sell, lend, transfer, or trade your account. You may not allow another person to access your account.
- You may not create more than one account per natural person unless we have given you explicit written permission.
- We may suspend or terminate accounts that we reasonably believe are duplicates, fraudulent, automated (bots), or in breach of these Terms.
- Notify us promptly at support@apparatengames.com if you suspect unauthorised use of your account.
4. Player Conduct
You agree that you will not, while using the Service:
- Cheat, exploit bugs, use unauthorised third-party software, scripts, bots, macros, scrapers, or modified clients;
- Interfere with the normal operation of the Service or any other player’s use of it (including denial-of-service, spamming, or flooding);
- Access, probe, or reverse-engineer the Service or its source code beyond what is permitted by mandatory law;
- Harass, threaten, defame, stalk, or impersonate other players or our staff;
- Post or transmit content that is unlawful, hateful, sexually explicit, violent against real persons, or that infringes intellectual property or privacy rights;
- Use the Service to promote, organise, or finance illegal activity;
- Buy, sell, trade, or transfer in-game assets, currency, or accounts for real-world value outside the channels we provide;
- Attempt to gain unauthorised access to other accounts, servers, or systems.
We may, at our discretion, warn, mute, kick, suspend, or permanently ban accounts that breach these rules, and may remove or edit user content. We are not obligated to monitor user behaviour but reserve the right to do so.
5. User-Generated Content
You retain ownership of content you submit (estate names, alliance names, chat messages, forum posts, banner customisations, feedback, etc.) (“User Content”). By submitting User Content you grant us a worldwide, royalty-free, non-exclusive, sublicensable, transferable licence to host, store, reproduce, modify, display, distribute, and create derivative works from that content for the purpose of operating, promoting, and improving the Service.
You represent that you have all rights necessary to grant this licence and that your User Content does not breach Section 4 above or any applicable law.
6. Virtual Goods and Paid Currency
The Game contains virtual currency (“Silver”) and virtual items (collectively, “Virtual Goods”), which can be earned in-game, granted by us, or purchased with real money via Swish (for domestic payments) or via Paddle.com, our reseller and Merchant of Record for international card and wallet payments.
- No real-world value. Virtual Goods are a limited, personal, non-transferable, non-sublicensable, revocable licence to use a feature of the Game. They have no monetary value, are not redeemable for cash or anything of monetary value, and do not constitute property of any kind.
- Non-transferable. Virtual Goods cannot be sold, transferred, gifted, or exchanged outside features we provide within the Game.
- No guarantee of availability. We may modify, replace, devalue, or remove Virtual Goods, change prices and exchange rates, or restrict access to them at any time.
- Wipe protection. If a world reset or wipe during the soft-launch period removes Silver that you purchased with real money, we will restore that Silver or, where restoration is not practical, refund the affected recent purchase. This protection covers purchased Silver only; Silver and Virtual Goods earned in-game or granted by us are not covered.
7. Purchases and Payment
Real-money purchases of Virtual Goods are processed through one of two channels, and the terms that apply depend on the channel used:
- Domestic payments (Swish). For payments made via Swish, we are the seller. Prices are shown in Swedish krona (SEK) and include VAT where applicable. Once Silver or other Virtual Goods have been delivered to your account, the purchase is treated as performed and the statutory EU 14-day right of withdrawal does not apply, in accordance with the Swedish Distance Contracts Act (lag (2005:59) om distansavtal och avtal utanför affärslokaler) for digital content delivered immediately with your consent.
- International card and wallet payments (Paddle). For these payments, Paddle.com is the Merchant of Record and seller of record. Paddle displays the price in your local currency and calculates, collects, and remits any applicable VAT or sales tax. These purchases are also governed by Paddle’s Buyer Terms, including Paddle’s refund handling, which you accept at checkout.
- If a purchase fails to deliver due to a technical issue on our side, contact support@apparatengames.com and we will investigate.
- We may refuse or cancel any purchase suspected of fraud, chargeback abuse, or breach of these Terms.
- Refunds are handled as described in our Refund Policy.
8. Intellectual Property
The Game, including all art, code, music, sound effects, text, lore, world maps, character designs, and trademarks, is owned by Visby Wild Crew AB or its licensors and is protected by copyright and other intellectual-property laws.
Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to access and play the Game for your private, non-commercial entertainment. All rights not expressly granted are reserved.
You may capture screenshots and video of your own gameplay and share them on personal social channels and streaming platforms, provided you do not imply our endorsement and do not use our assets to create a competing product.
9. Suspension and Termination
- You may close your account at any time by contacting us. Closing your account forfeits any unused Virtual Goods.
- We may suspend or terminate your account, with or without notice, if we reasonably believe you have breached these Terms, created risk to other players or to us, or if continued operation would be impractical or unlawful.
- On termination, your right to use the Service ends immediately. Sections of these Terms that by their nature should survive termination (including Sections 5, 6, 8, 10, 11, and 12) will continue to apply.
10. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or freedom from defects, errors, or harmful components.
This section does not exclude or limit any rights you have as a consumer under mandatory Swedish or EU law that cannot lawfully be waived.
11. Limitation of Liability
To the maximum extent permitted by law, Visby Wild Crew AB and its directors, employees, and contractors will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, data, goodwill, or in-game progress, arising out of or in connection with the Service.
Our total aggregate liability to you for any claim arising out of or related to the Service is limited to the greater of (a) the total amount you have paid to us in the twelve (12) months preceding the event giving rise to the claim, or (b) SEK 500.
Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited under Swedish law.
12. Changes to the Service and to These Terms
We may revise these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date. Material changes will be announced in-game or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to a change, your sole remedy is to stop using the Service and close your account.
13. Privacy
Your privacy is important to us. Our Privacy Policy describes how we collect, use, and protect personal data, including the legal bases on which we process it under the EU General Data Protection Regulation (GDPR). To exercise your data-protection rights, contact privacy@apparatengames.com.
14. Governing Law and Disputes
These Terms are governed by the laws of Sweden, without regard to its conflict-of-laws rules. Disputes arising out of or in connection with these Terms shall be resolved by the competent Swedish courts, with Gotlands tingsrätt as the court of first instance, unless mandatory consumer-protection rules in your country of residence give you the right to bring proceedings in another forum.
If you are a consumer in the EU, you may also use the European Commission’s online dispute-resolution platform at ec.europa.eu/consumers/odr. Swedish consumers may also contact the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden) at arn.se.
15. Miscellaneous
- Entire agreement. These Terms, together with any documents they reference, constitute the entire agreement between you and us regarding the Service.
- Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
- No waiver. Our failure to enforce any right is not a waiver of that right.
- Assignment. You may not assign these Terms. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
- Force majeure. We are not liable for failure or delay caused by events beyond our reasonable control.
